TCE and other toxic contamination at the Cherokee site is already being cleaned up under the Voluntary Cleanup Program (VCUP). The Gates/East site applied to the VCUP program on March 2, 2005. They are planning to clean up the toxic contamination on their site before selling it to a developer.

What is the Voluntary Cleanup Program?
Through the Voluntary Cleanup Program (VCUP), property owners, developers, local officials or individuals may voluntarily enter into an agreement with the Colorado Department of Public Health and Environment (CDPHE) to cleanup contaminated sites to foster the transfer and redevelopment of properties. There are several former VCUP sites in Denver that have successfully completed clean-up activities including the Pepsi Center, Ocean Journey and the Stapleton Redevelopment.

Applications to CDPHE for approval of a voluntary clean-up plan are reviewed using a risk-based approach based upon the proposed land use, to ensure the clean-up process will be protective of human health and the environment. An applicant may also seek a no action determination where the property is not a threat to public health or environment, or they may remediate the property on their own and seek a no action determination. Cleanup sites must still comply with all applicable federal state and local regulations. This program is designed for sites that do not fall under the regulatory jurisdiction of other cleanup programs such as Superfund.


How can you learn more about Voluntary Cleanup sites in your area?
Voluntary Cleanup sites in Denver from 2002-2005 are listed on the CDPHE web site. Members of the public may request to view the cleanup application and plans at the CDPHE. The process currently has no format requirements for public participation.

CDPHE will work closely with Denver Environmental Health (DEH) as new applications are submitted DEH will notify registered neighborhood organizations adjacent to the property and any other interested parties of any new Voluntary Cleanup applications in Denver. CDPHE may request that the applicant hold a public meeting to explain its cleanup plan on a case by case basis. CDPHE and DEH also will attend neighborhood community meetings upon request.

By mid-2005, a link from the voluntary cleanup website (see web address below) will offer an address search feature that maps environmental clean-up sites located within specified distances of an -address.

Help watch over the cleanup at the Cherokee & Gates properties
Join us for the launch of a Voluntary Cleanup Advisory Board, monitoring cleanup of TUE and other contamination at the former Gates Rubber Plant (south of 1-25 & Broadway). We hope this pilot project will become a model for citizen participation at Voluntary Cleanup (VCUP) toxic sites elsewhere in Colorado.
